Age and Capacity Requirements

Rules of Use and Prohibited Conduct
You commit to using the Service in a legal, responsible and respectful manner. In particular, you cannot:
- Infringe intellectual property rights, image, privacy or any other rights of third parties or Snapbum - Publish, share or facilitate illegal, violent, threatening, harassing, defamatory, discriminatory, sexually explicit content or content that promotes illegal activities - Use the Service for spam, mass harvesting, auto-responses, data extraction or unauthorized automated mailings - Attempt to access accounts, systems or networks without authorization, or circumvent security measures - Track, scrape or collect data from the Service through automated means without express authorization - Copy, modify, decompile, reverse engineer or attempt to obtain the source code or logic of the Service, except where the law expressly permits - Use the Service for unauthorized commercial purposes or on behalf of third parties without permission - Manipulate the Service experience, such as inflating metrics, generating false interactions or interfering with its operation
Failure to comply with these rules may result in account suspension or closure, content removal or other reasonable measures.
Intellectual Property and Service Rights
The Service and all its elements (software, design, trademarks, logos, interfaces, texts and graphics) are protected by intellectual and industrial property regulations.
Unless expressly stated, you do not acquire any property rights over the Service. We grant you a limited, personal, non-exclusive, non-sublicensable and non-transferable license to use the Service in accordance with these Terms.
User Content and Licenses
User Content: All content that you upload, share or publish through the Service (photos, texts, messages or descriptions within a Snapbum) is User Content. You are solely responsible for such content and declare that: - You have the necessary rights, licenses and permissions - The content complies with these Terms and applicable law
License you grant us: To operate the Service, you grant us a non-exclusive, worldwide, royalty-free and limited license to the provision of the Service to: - Host, store, reproduce and display your content - Adapt it for technical reasons - Make it available to the people you choose to share it with
This license remains in effect while the content remains in the Service and ends when you delete the content or your account, except for temporary technical copies or legal obligations.
License between users: If you share content within a Snapbum, you grant other users a limited license to access and view that content within the Service.
Infringement Reports and Content Removal
If you believe any content infringes rights, you can report it to contact@snapbum.com indicating: - Identification of the content and its location - Explanation of the allegedly infringed right - Documentation certifying your legitimacy - Your contact details
Child Safety Standards and Protection of Minors (EASi)
Snapbum Tech, S.L. has a zero-tolerance policy regarding any content or conduct that exploits, harms, or threatens minors. In strict compliance with global child safety standards and Google Play policies, we enforce rigorous measures against Child Sexual Exploitation and Abuse (CSAE) and Child Sexual Abuse Material (CSAM).
1. Prohibited Content and Conduct: You are strictly prohibited from publishing, sharing, transmitting, soliciting, or storing any form of CSAE or CSAM through the Service. This includes, but is not limited to, any visual, textual, or digital depictions of minor abuse or exploitation.
2. Immediate Mitigation and Enforcement: If Snapbum Tech, S.L. becomes aware of any violation involving CSAE or CSAM, we will take immediate action, which includes: - The permanent and irreversible removal of the offending content. - The immediate and permanent termination of the responsible user's account without prior notice. - Reporting the incident, including relevant user data, to competent legal authorities, such as the National Center for Missing & Exploited Children (NCMEC) and Spanish law enforcement agencies (Fuerzas y Cuerpos de Seguridad del Estado).
3. Reporting Mechanisms and Dedicated Contact: - In-App Reporting: The Service provides an easy-to-use, integrated in-app reporting mechanism within the user interface. Users can instantly report profiles, messages, or content that violates these child safety standards without leaving the application. - Dedicated Point of Contact: For specific inquiries or urgent escalations regarding child safety, you can contact our designated safety point of contact at contact@snapbum.com. All child safety reports are treated with the highest priority.
Responsibility for What You See and Do
The Service may include content provided by other users. We do not guarantee its accuracy, completeness or legality. You use the Service at your own risk.
We may remove content when there is non-compliance with these Terms or risk to the Service, users or third parties.
The Service may contain links to third-party services. We are not responsible for their contents, policies or practices.
Modifications, Suspension and Termination of Service
We may modify, suspend or discontinue parts of the Service for technical, security, legal or business reasons.
We may suspend or close your account if you violate these Terms, we detect fraudulent activity or there is a legal obligation.
Pricing
The Service may be free or include paid features in the future. In that case, we will inform you in advance of the applicable terms.
Account Closure
You can stop using the Service at any time. If there is no automatic option, you can request closure by writing to contact@snapbum.com.
Closure may result in loss of access to associated content and data. See the Privacy Policy for more information.
Mobile Applications and App Store Terms
If you use the app from an app store, your use is also subject to that store's terms.
On iOS, these Terms are between you and Snapbum. Apple is not responsible for the Service or content, and Snapbum is responsible for addressing complaints related to the Service.
Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and as available. We do not guarantee that it will be uninterrupted or error-free.
Limitation of Liability
To the maximum extent permitted by law, Snapbum shall not be liable for indirect, incidental, consequential damages or lost profits arising from your use of the Service, except in cases that are legally irrevocable.
Indemnification
You commit to holding Snapbum harmless against claims arising from your use of the Service, your content or infringement of third-party rights.
Applicable Law and Jurisdiction
These Terms are governed by Spanish law.
